WeTransfer’s New Terms of Service: What Section 6.3 Means for Your Content

What Does Section 6.3 Actually Say?
WeTransfer’s newly updated terms include the following clause:
6.3. License to WeTransfer. In order to allow us to operate, provide you with, and improve the Service and our technologies, we must obtain from you certain rights related to Content that is covered by intellectual property rights. You hereby grant us a royalty-free license to use your Content for the purposes of operating, developing, and improving the Service, all in accordance with our Privacy & Cookie Policy.
On the surface, this might sound like standard tech-speak, but the implications are significant.
What This Could Mean for Your Files
The phrase "license to use your Content" - even with the stated purpose of improving the service - opens the door to data harvesting, AI training, and broader internal analysis of your files. WeTransfer says this is to improve their platform, but the reality is that this kind of vague language has become a standard backdoor for companies looking to leverage user data for commercial or AI-related purposes.
This could include:
- Analysing the contents of your uploads to inform product development
- Training internal machine learning models using customer files
- Sharing anonymised data insights with third parties
While WeTransfer may not be explicitly selling your files, your uploads are no longer just your business - they are potentially feeding into WeTransfer’s.
Why This Matters
If your business handles sensitive files - client documents, commercial contracts, creative assets, proprietary code - you need to be confident that they aren’t being used beyond the purpose of delivery.
Section 6.3 introduces legal ambiguity around how your intellectual property could be repurposed, particularly in an era where companies are increasingly monetising data behind the scenes.
